Terms and Conditions (T&C)

1. Scope of Application 

These Terms and Conditions apply to all creative services as well as the sale of finished artworks commissioned or acquired through Atelier Niyol – such as artworks, analogue pieces, digital illustrations, pet portraits, wall designs, or graphic works for marketing materials.

2. Process and Communication 

The implementation of a project takes place in consultation with the client. Ideas, wishes, or content requirements should be formulated as clearly as possible. I will keep you updated during the process – depending on the project scope, in one or more intermediate phases.

3. Prices and Payment 

Prices are based on scope, technique, and time spent and are agreed upon individually. Upon request, a target price or a budget limit can be set. Payment is made via TWINT, advance payment (bank transfer), or purchase on account. After project completion (or at the start of the order, depending on the agreement), you will receive an invoice via email. The payment period is 30 days, unless otherwise agreed. Depending on the project and the billing address, the Greek statutory value added tax (ΦΠΑ) may additionally apply.

3a. Conclusion of Contract (Online Shop) 

The presentation of artworks in the Online Shop serves as a non binding presentation. By completing the ordering process, you submit a binding purchase offer. The contract is concluded as soon as payment has been made and the order is confirmed via email.

3b. Shipping, Delivery and Collection 

All prices are exclusive of shipping costs. The available shipping methods and the corresponding costs are displayed during the ordering process. Alternatively, collection at the studio can be selected. In this case, no shipping costs will be charged. For deliveries abroad, additional customs duties, taxes, or fees may apply, which are to be borne by the buyer.

4. Rights of Use 

Upon full payment, you receive a license to use the commissioned work for the agreed purpose (e.g. private use, marketing, social media). Unless otherwise agreed, this is a simple, non transferable license that does not grant exclusive rights. The copyrights remain with me. Any distribution, processing, sublicensing, or commercial use outside the agreement requires my written consent. If needed, extended or additional licenses (e.g. for commercial use, exclusive rights, or wider reach) can be purchased separately.

5. Withdrawal and Cancellation 

Withdrawal from the order is possible at any time. Services already rendered will be invoiced proportionally. In the event of short term withdrawal (after project start), a cancellation fee may be charged.

6. Liability I work carefully, creatively, and in dialogue, but I am not liable for the subsequent use or technical implementation by third parties (e.g. print shops, website providers etc.).

7. Returns and Transport Damage 

A return or exchange of finished artworks is generally excluded. Transport damage is excepted. In this case, the artwork must be inspected immediately upon receipt. Transport damage must be reported in writing within 48 hours of delivery and documented with clear photos. After examining the damage, a repair, a replacement, or a refund of the purchase price will be made, depending on the situation. The costs for return shipping in the case of recognized transport damage will be covered by me.

8. Ownership and Copyright for Finished Artworks 

With the purchase of a physical artwork, ownership of the work passes to the buyer. The copyrights remain with me. Any reproduction, publication, processing, or commercial use of the work is not permitted without my express written consent.

9. Representation and Color Deviations 

The representation of the artworks in the Online Shop or on social networks is done to the best of my knowledge and belief. Colors, textures, and details may deviate from the photo shown depending on screen display, lighting conditions, surroundings, and wall color. These perception related differences do not constitute a defect.

10. Final Provisions 

By completing an order or placing a commission, these Terms and Conditions are deemed accepted. The substantive law of Greece applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers residing in the European Union, this choice of law only applies insofar as no mandatory consumer protection regulations of the respective country of residence are restricted. The place of jurisdiction is – as far as legally permissible – the registered office of Atelier Niyol in Greece.
